THE HAGUE CONVENTION TREATY

There is a treaty called the Hague Convention which is held on October 5th 1961 abolishing the requirement of Legislation for foreign public documents. This is commonly known as the Apostille Convention which is having over 120 countries as members in it do not require an embassy attestation of documents from people among them. The reason UAE is not a member in it demanding Apostille Attestation. Essentially Apostille is an internationally accepted attestation in about 92 countries and most of the western world recognizes apostille. Apostille guarantees an international legality of a document whereas notary and common attestation verifies its legal validity of document signature by an individual. Apostille stamp is a computer-generated sticker stamp in a square-shaped, fixed on the opposite of the certificate. This has a different ID number, by which any associate nation of The Hague convention can verify its legitimacy online. Prompt attestation is well known for apostille services. The document which has apostille stamp in one member country is acceptable in all the other member countries which are 104 countries as of the year 2018. This is the final department who verifies all the documents before it leaves the home country. Some of the countries which are part of Hague Convention are as follows – Australia / Bahrain / Cyprus / Denmark / Ecuador / France / Germany /Japan / Italy / Luxembourg / Mexico / New Zealand / Poland / Russia/ Oman / South Africa / Turkey / UK / USA and many more countries.

APOSTILLE ATTESTATION

This is a kind of legalization of documents that identifies whether the relevant authority issues the official seals, stamps and signatures on a document. This includes personal, official, public documents issued in another country. As long as UAE isn’t a part of the Hague Convention; the documents have to be verified by the Ministry of Foreign Affairs of the country issuing the documents as well as the Ministry of Foreign Affairs here in UAE. Those who live in UAE who wants to travel to any country that is a member of Hague Convention will need Apostille. While the Apostille is used in countries participate sin Hague Convention whereas the Authentication certificates are used for the countries which do not participate in this convention. An Apostille may only be rejected when their formal elements are differed radically from the model certificates annexed in the convention.

THE REQUIREMENTS FOR AN APOSTILLE ATTESTATION IN UAE

  • Original Degree Certificate, diploma certificate, school certificate (high school certificate, higher secondary certificate, transfer certificate (TC) which is to be attested
  • birth certificate, marriage certificate, divorce certificate, death certificate, power of attorney, affidavits and many more or employment contract or offer letter, court orders or any other public document (Original duly attested in UAE, if available)
  • Emirates ID and Passport of the applicant
  • Power of Attorney for processing of degree attestation by any service provider
  • Copy of Mark Sheet
